If it's not in the certificate then our attorneys have proof the Trust doesn't have legal standing. The foreclosure can also be tossed if the the Trustee and/or the Servicer are not in compliance with the PSA. Could the Trustee re-file or appeal? Yes, but it would be futile at best because the homeowner's attorney has proved the Trustee lacks standing beyond any doubt. Does this mean the homeowner's obligation under the terms of the mortgage are removed? No, but the Servicer and/or the Trustee is blocked from collecting payments from the homeowner because only the owner of the note can execute the terms of the note and mortgage. If the real owner doesn't appear after a certain amount of time, the homeowner can file quiet claim action and have the lien removed.
